§1. General Provisions
- These Terms of Service define the rules for using the website operated at https://echosense.pl belonging to Echo Sense Sp. z o.o. with its registered office in Stalowa Wola at ul. Eugeniusza Kwiatkowskiego 9, 37-450 Stalowa Wola, entered in the National Court Register under KRS number 0001199133, NIP 8652590799, REGON 542532409.

- Using the website constitutes acceptance of these Terms of Service.
- These Terms of Service are made available on the website in a manner enabling their retrieval, reproduction, and retention.
§2. Scope of Services
- Services offered through the website are informational or transactional in nature, as determined by the Service Provider.
- The website enables users to review the offer of Echo Sense Sp. z o.o. and make payments for offered products or services via an external payment gateway.
- The website also allows users to sign up for the contact list or newsletter upon providing voluntary consent.
§3. Terms of Use
- The User undertakes to use the website in compliance with applicable law, good practices, and the provisions of these Terms of Service.
- The User is prohibited from providing unlawful content, including in particular offensive, vulgar content, or content infringing the rights of third parties.
- The Service Provider shall not be liable for interruptions in the operation of the website resulting from technical causes beyond its control.
§4. Payments
- Payments are made through an external payment operator. Detailed information and terms are provided to the User before making a payment.
- Echo Sense Sp. z o.o. does not store payment card data or other confidential payment information.
- In case of payment problems, the User should contact the Service Provider at hello@echosense.eu.
§5. Order Fulfillment
- Orders placed through the website are fulfilled after payment acceptance by the Przelewy24 payment operator.
- The order fulfillment period is up to 7 business days, unless otherwise stated in the description of the given service or product.
- In the case of electronic services (e.g., platform access, online consultations, etc.), fulfillment occurs immediately or promptly upon receipt of payment confirmation.
- In the event of delays in order fulfillment, the Service Provider shall promptly notify the Customer by electronic means.
§6. Right of Withdrawal
- A Customer who is a Consumer has the right to withdraw from a distance contract within 14 calendar days from the date of contract conclusion or from the date of delivery of the goods.
- To exercise the right of withdrawal, the Customer should send a withdrawal statement to the e-mail address: hello@echosense.eu or by phone.
- In the case of withdrawal from a contract concerning a physical product, the Customer is obliged to return the ordered product to the address: Echo Sense Sp. z o.o., Eugeniusza Kwiatkowskiego 9, 37-450 Stalowa Wola. The return should be made no later than within 14 calendar days from the date of submitting the withdrawal statement.
- A withdrawal form template is available as an attachment to these Terms of Service.
- The right of withdrawal does not apply in cases provided for in Article 38 of the Consumer Rights Act, in particular:
- provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer;
- delivery of digital content not recorded on a tangible medium, if the performance has begun with the express consent of the consumer and after informing them of the loss of the right of withdrawal.
- In the case of an effective withdrawal, the refund shall be made within 14 days from receipt of the withdrawal statement, using the same payment method used by the Customer.
§7. Complaints
- The Customer has the right to file a complaint regarding the operation of the website, payments, or order fulfillment.
- Complaints should be submitted electronically to: hello@echosense.eu, providing first name, last name, e-mail address, and a description of the problem.
- In the case of complaints regarding physical products, the product should be returned to the address: Echo Sense Sp. z o.o., Eugeniusza Kwiatkowskiego 9, 37-450 Stalowa Wola. The shipment should include a description of the defect, contact details, and proof of purchase (e.g., order number or copy of payment confirmation). Shipping costs for the complaint are borne by the Customer; however, if the complaint is accepted, the costs will be refunded.
- Complaints are reviewed within 14 business days from the date of receipt.
- If the complaint does not contain the required necessary information, the Service Provider may request the Customer to supplement it, and the review period shall be counted from the moment of its completion.
- The Customer shall be informed of the complaint decision by electronic means.
§8. Personal Data Protection
- Users' personal data is processed in accordance with the principles set out in the Privacy Policy, available on the website.
- The User has the right to access their data, correct it, request its deletion, and restrict its processing.
§9. Final Provisions
- The Service Provider reserves the right to make changes to these Terms of Service.
- In matters not regulated by these Terms of Service, the provisions of Polish law shall apply, in particular the Civil Code and the Act on Provision of Electronic Services.
- These Terms of Service shall be effective from the date of their publication on the website.
